PLEASE READ THESE TERMS CAREFULLY. By accessing, browsing, registering on, or using The Growth Sage platform in any manner, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you must immediately discontinue use of the Platform. These Terms constitute a legally binding agreement between you and The Growth Sage. These Terms are an electronic record published under the Information Technology Act, 2000 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and require no physical or digital signature. THESE TERMS INCLUDE A MANDATORY ARBITRATION CLAUSE AND A CLASS ACTION WAIVER. PLEASE REVIEW SECTION 19 CAREFULLY.
By using the Platform in any capacity as a visitor, registered user, contributor, listed company, or community member you agree to these Terms, our Privacy Policy, and any additional guidelines, policies, or rules published on the Platform, all of which are incorporated herein by reference. The Growth Sage reserves the right to update, amend, or replace these Terms at any time at its sole discretion. Updated Terms will be posted on the Platform with a revised effective date. Your continued use of the Platform after any such update constitutes your acceptance of the revised Terms. If you do not agree with updated Terms, you must stop using the Platform.
For the purposes of these Terms, the following definitions apply:
To use the Platform, you must: (a) be at least 18 years of age; (b) have the legal capacity to enter into a binding agreement; (c) not be prohibited from using the Platform under applicable law in your jurisdiction; and (d) if accessing on behalf of a company or organization, have the authority to bind that entity to these Terms. By using the Platform, you represent and warrant that you meet all of the above eligibility requirements. The Growth Sage reserves the right to refuse access to any individual or entity at its sole discretion, including for violations of these Terms or applicable law.
Certain features of the Platform require you to create an account. When registering, you agree to provide accurate, current, and complete information and to keep your account information updated at all times. You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password, and for all activity that occurs under your account.
You must notify The Growth Sage immediately at legal@thegrowthsage.com if you suspect any unauthorized use of your account or any security breach. The Growth Sage will not be liable for any loss or damage arising from your failure to protect your account credentials or from unauthorized access to your account resulting from your own actions or negligence.
The Growth Sage reserves the right to suspend or terminate your account at any time, with or without notice, for any reason including but not limited to violation of these Terms, provision of inaccurate information, or conduct that we determine, in our sole discretion, to be harmful to the Platform, other users, or third parties.
The Platform provides a directory and marketplace where B2B software products, SaaS tools, and professional services can be listed, discovered, reviewed, and compared. Listings may be added by The Growth Sage’s team based on publicly available information, or claimed and managed directly by the relevant company. The Growth Sage acts solely as a neutral directory and discovery platform and is not a party to any transaction, agreement, or relationship between Users and Listed Companies.
The Platform hosts community spaces dedicated to topics including but not limited to sales, marketing, and entrepreneurship. These communities may feature interviews, expert content, discussions, and member contributions. Community membership and participation are subject to these Terms and any community-specific guidelines published on the Platform.
Verified Contributors may publish articles, interviews, thought leadership content, and other written or multimedia materials on the Platform. Content publishing is available to approved contributors only, subject to our editorial guidelines. The Growth Sage reserves the right to accept, reject, edit, modify, or remove any submitted content at its sole discretion and without liability.
The Platform’s offerings are not limited to those described above. The Growth Sage may introduce new features, tools, services, subscription products, premium tiers, or other offerings at any time without prior notice. Use of any new offerings will be subject to these Terms and any additional terms we may publish at that time.
Companies listing their products or services on the Platform, whether via team addition or self-claiming, agree to the following:
The Platform allows Users to submit reviews and ratings for listed software and services. By submitting a review, you agree to the following:
When you post, upload, submit, or publish any User Content on the Platform including reviews, articles, comments, interview responses, images, videos, or any other materials you grant The Growth Sage a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, transferable, and fully sublicensable license to use, access, store, reproduce, modify, adapt, translate, distribute, publish, publicly perform, publicly display, create derivative works from, and otherwise exploit such User Content in any media format, through any channels, for any purpose including but not limited to Platform operation, marketing, promotion, research, and product development.
You represent and warrant that: (a) you own or have the necessary rights and permissions to submit the User Content and grant the above license; (b) the User Content does not infringe any third-party intellectual property rights, privacy rights, or other rights; (c) the User Content complies with these Terms and applicable law; and (d) the User Content does not contain any false, misleading, defamatory, harmful, obscene, or illegal content.
The Growth Sage does not claim ownership of your User Content but reserves all rights granted under the license above. You acknowledge that The Growth Sage is not obligated to publish, display, or maintain any User Content and may remove it at any time at our sole discretion and without liability.
The Growth Sage reserves the right to use your name, likeness, and any content you publish on the Platform for promotional or marketing purposes. Where we wish to specifically feature your brand name or logo in our marketing materials, we will seek your prior permission.
The right to publish editorial content, articles, and interviews on the Platform is reserved for verified contributors approved by The Growth Sage. To become a verified contributor, you must apply through the Platform and meet our editorial standards. Approval is at The Growth Sage’s sole discretion and may be revoked at any time.
Verified Contributors are responsible for the accuracy, originality, and legality of all content they submit. By submitting content as a Contributor, you confirm that the content is original, does not infringe third-party rights, and complies with these Terms and our editorial guidelines. The Growth Sage may edit, modify, or decline to publish any submitted content without obligation to explain its decision.
Content published by Contributors represents the views of the individual contributor and not those of The Growth Sage. The Growth Sage is not responsible or liable for any Contributor content.
All content on the Platform that is not User Content including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, software, and the overall design and compilation of the Platform is the property of The Growth Sage or its licensors and is protected by applicable intellectual property laws worldwide. You may not copy, reproduce, modify, distribute, transmit, display, publish, sell, license, or create derivative works from any Platform content without our express prior written consent.
“The Growth Sage” and associated logos and marks are trademarks of The Growth Sage, whether registered or unregistered. Nothing in these Terms grants you any right to use our trademarks, trade names, logos, or other brand features without our prior written permission.
Any feedback, suggestions, ideas, enhancement requests, recommendations, or other input you provide to The Growth Sage regarding the Platform or its services shall become the sole and exclusive property of The Growth Sage upon submission. You hereby irrevocably assign to The Growth Sage all rights, title, and interest in such submissions, including all intellectual property rights, without any obligation of compensation, credit, or acknowledgement. The Growth Sage may use, incorporate, modify, or discard any such submission at its sole discretion.
By using the Platform, you agree not to:
The Growth Sage reserves the right to investigate and take appropriate action against any User who violates these prohibitions, including suspending or terminating accounts, removing content, and reporting to law enforcement authorities.
THE GROWTH SAGE OPERATES SOLELY AS A NEUTRAL DISCOVERY AND DIRECTORY PLATFORM. WE ARE NOT A PARTY TO ANY TRANSACTION, AGREEMENT, CONTRACT, OR RELATIONSHIP BETWEEN USERS AND LISTED COMPANIES. WE DO NOT SELL, RESELL, ENDORSE, VERIFY, CERTIFY, OR GUARANTEE ANY PRODUCT OR SERVICE LISTED ON THE PLATFORM.
The Growth Sage expressly disclaims all responsibility and liability for:
Users engage with Listed Companies entirely at their own risk. The Growth Sage strongly recommends that you conduct your own due diligence before entering into any agreement with a Listed Company.
The Growth Sage may offer paid features, including but not limited to featured listings, sponsored placements, premium community access, and other products or services (“Paid Features”). The availability, pricing, and terms of Paid Features will be communicated on the Platform at the time of purchase. All prices are subject to change without notice.
Payments for Paid Features may be processed through third-party payment gateways including but not limited to Razorpay, Stripe, PayPal, and other processors we may designate from time to time. By making a payment, you agree to the terms and conditions of the relevant payment processor. The Growth Sage does not store your payment card details on its servers. All payment data is handled by the relevant payment processor in accordance with their own privacy and security policies.
ALL PAYMENTS MADE TO THE GROWTH SAGE ARE FINAL AND NON-REFUNDABLE. THE GROWTH SAGE DOES NOT OFFER REFUNDS, CREDITS, OR EXCHANGES UNDER ANY CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO: CHANGE OF MIND, DISSATISFACTION WITH THE PLATFORM, ACCOUNT TERMINATION (WHETHER VOLUNTARY OR BY THE GROWTH SAGE), TECHNICAL ISSUES, OR FAILURE TO USE PURCHASED FEATURES WITHIN ANY APPLICABLE PERIOD.
To the extent that applicable consumer protection law in your jurisdiction mandates refund rights that cannot be contractually waived, those statutory rights shall apply notwithstanding the above. Users in the European Union should note that statutory consumer rights under EU law may provide certain refund entitlements for digital services, and nothing in these Terms is intended to exclude rights that cannot legally be excluded.
You are solely responsible for any taxes, duties, or levies applicable to your purchase of Paid Features in your jurisdiction. The Growth Sage will charge applicable taxes where required by law.
THE PLATFORM AND ALL SERVICES, CONTENT, AND FEATURES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE ACCESS.
THE GROWTH SAGE DOES NOT WARRANT THAT: (A) THE PLATFORM WILL BE AVAILABLE AT ALL TIMES OR FREE FROM ERRORS, BUGS, OR INTERRUPTIONS; (B) ANY CONTENT ON THE PLATFORM IS ACCURATE, COMPLETE, RELIABLE, OR UP TO DATE; (C) ANY DEFECTS WILL BE CORRECTED; OR (D) THE PLATFORM IS FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
You use the Platform entirely at your own risk. The Growth Sage reserves the right to modify, suspend, or discontinue any aspect of the Platform at any time without notice or liability.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE GROWTH SAGE, ITS OPERATORS, ADMINISTRATORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR USE OF OR INABILITY TO USE THE PLATFORM; (B) ANY CONTENT, LISTING, OR REVIEW ON THE PLATFORM; (C) ANY TRANSACTION OR INTERACTION BETWEEN YOU AND A LISTED COMPANY; (D) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; OR (E) ANY OTHER MATTER RELATING TO THE PLATFORM.
IN NO EVENT SHALL THE TOTAL CUMULATIVE LIABILITY OF THE GROWTH SAGE TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM EXCEED THE AMOUNT PAID BY YOU TO THE GROWTH SAGE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR INR 1,000 (ONE THOUSAND INDIAN RUPEES) IF YOU HAVE MADE NO PAYMENTS, WHICHEVER IS LOWER.
Some jurisdictions do not allow the exclusion or limitation of certain types of liability, in which case the above limitations shall apply to the fullest extent permitted by applicable law.
You agree to defend, indemnify, and hold harmless The Growth Sage, its operators, administrators, affiliates, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Platform; (b) any User Content you submit; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; (e) your interaction with any Listed Company; or (f) any claim that your User Content infringes the rights of a third party. The Growth Sage reserves the right to assume exclusive control of any matter subject to indemnification by you, at your expense.
These Terms are effective from the date you first access or use the Platform and continue until terminated. The Growth Sage may, at its sole discretion, suspend or permanently terminate your access to the Platform at any time, with or without notice, for any reason, including but not limited to violation of these Terms, harmful conduct, or inactivity.
Upon termination: (a) your right to access and use the Platform ceases immediately; (b) The Growth Sage may retain your data in accordance with our Privacy Policy; (c) any User Content you have submitted may remain on the Platform at The Growth Sage’s discretion; (d) all provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification obligations, and dispute resolution provisions.
You may terminate your account at any time by contacting us. Termination does not entitle you to any refund of any amounts paid.
By registering on the Platform, you consent to receive marketing communications, newsletters, promotional content, and platform updates from The Growth Sage via email and other digital channels. You may opt out of marketing communications at any time by clicking the unsubscribe link in any marketing email or by contacting us at legal@thegrowthsage.com. Please note that even after opting out of marketing communications, you may continue to receive transactional and administrative communications related to your account and use of the Platform.
Before initiating any formal dispute resolution process, you agree to first contact The Growth Sage at legal@thegrowthsage.com and attempt to resolve the dispute informally. The Growth Sage will make reasonable efforts to resolve the matter within 30 days of receiving your complaint. This informal resolution step is a prerequisite to initiating arbitration.
If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, or your use of the Platform including any question regarding the existence, validity, interpretation, breach, or termination of these Terms shall be finally settled by binding arbitration administered in accordance with the UNCITRAL Arbitration Rules (or such other internationally recognized arbitration rules as The Growth Sage may designate) by a sole arbitrator. The seat of arbitration shall be Bangalore, India, unless The Growth Sage elects otherwise. The arbitration shall be conducted in English. The arbitrator’s decision shall be final and binding and may be enforced in any court of competent jurisdiction.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST THE GROWTH SAGE. ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Notwithstanding the above, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending the conclusion of arbitration. Nothing in this section limits The Growth Sage’s right to seek injunctive relief for violations of its intellectual property rights.
To the extent that court proceedings are permitted or required under these Terms, both parties submit to the non-exclusive jurisdiction of the courts of Bangalore, Karnataka, India, without prejudice to any other jurisdiction that may be applicable.
These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, the Indian Contract Act, 1872, and other applicable Indian legislation, without regard to conflict of law principles. For users in other jurisdictions, applicable mandatory consumer protection and data protection laws of your local jurisdiction shall also apply where they cannot be contractually excluded.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction or arbitrator, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
These Terms, together with our Privacy Policy and any additional terms, guidelines, or rules published on the Platform, constitute the entire agreement between you and The Growth Sage with respect to your use of the Platform and supersede all prior or contemporaneous agreements, representations, and understandings, whether written or oral, relating to the same subject matter.
The failure of The Growth Sage to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver by The Growth Sage of a breach of any provision of these Terms shall not be deemed a waiver of any subsequent breach of the same or any other provision.
The Growth Sage shall not be liable for any delay or failure to perform its obligations under these Terms due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, internet outages, cyber attacks, power failures, or any other event beyond The Growth Sage’s reasonable control.
The Growth Sage reserves the right to modify, update, or replace these Terms at any time at its sole discretion. Where changes are material, we will provide notice via email or a prominent notification on the Platform. All changes take effect from the date they are posted unless otherwise stated. Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of the changes.
In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, The Growth Sage has designated a Grievance Officer to address complaints and concerns relating to these Terms, User Content, Platform conduct, or any other matter relating to the Platform.
